I agree that such rights to seek redress against employers should not be eliminated. Tort reform on a federal level should not occur. It's a states rights issue.
Most, probably all, states already have rules or laws to deal with frivolous law suits.
The "reform" that is really needed is harder penalties to address frivolous defenses. I am an attorney in Massachusetts where I usually represent employees. I rarely see frivolous law suits, but I often see frivolous defenses raised in response to meritorious claims.
As I recall your wife was the person fired. I am sorry she suffered this blow, and hope she will get a just resolution. If she has to file suit, I think you will see what I mean about frivolous defenses.
