There has been a concerted effort by a minority of Democrats in the U.S. Senate to prevent President Bush’s judicial nominees from receiving up-or-down votes on the Senate floor. The obstructionist tactic being used is the judicial filibuster.

The use of a filibuster to block judicial nominees is not only wrong, but unconstitutional. At the American Center for Law and Justice, we are working with members of the Senate – advising them about the constitutional options available to bring an end to this tactic.

The country is at a critical crossroads. There are numerous vacancies in the federal judiciary and vacancies likely to occur at the Supreme Court in the near future. The President’s judicial nominees must be given up-or-down vote by the full Senate. And to do that, we must eliminate the unconstitutional use of judicial filibusters.

Petition to End Judicial Filibusters

The Constitution is very clear that the role of the Senate is to provide advice and consent regarding the President’s judicial nominees.  Judicial filibusters thwart that attempt.  We now call on the leadership of the Senate and the Senate Judiciary Committee to move swiftly to enact a rules change in the Senate prohibiting the use of judicial filibusters.
