Carter may have pardonded him BUT he is in violation of
of the US Constitution 14th Amendment Section 3
And no presidential pardon has the authority to lift the ban on federal office under the 14th amendment. To lift the ban requires a 2/3rds vote by both the Senate and the House.
2 USC Sec. 39, reads: The Secretary of the Senate and the Chief Administrative Officer of the House shall deduct from the monthly payments (or other periodic payment authorized by law) of each Member or Delegate the amount of his salary for each day that he has been absent from the Senate or House, respectively, unless such Member or Delegate assigns as the reason for such absence the sickness of himself or of some member of his family.They will simply just choose not to enforce this section of the Constitution as well. There is one set of laws for some people another set of laws for others. Then there are some people to whom laws don't count (John Kerry, Sandy Berger, et al.)
Carter couldn't pardon him. The very first act Carter performed as Pres. - first HOUR! - was to pardon the draft dodgers, but Kerry wasn't a draft dodger - he had been an officer in the military...and had a less than honorable discharge from, I believe, 1972.
For his record to be covered up and reversed - it took a special board of inquiry - which was held...by the same list of perpetrators - We have a right to see all this. (He admitted that the medals he threw away hadn't been his - indeed, he proudly displays his medals on his office wall. HOWEVER, when you get a less than honorable discharge, you are required to turn in your medals. Kerry may not be required, by law, to sign the 180 - BUT, I wonder if the other machinations can't be uncovered thru' Freedom of Information? = I believe this took place in 1978 - would it be in the Congressional/Senate/Navy records that could be requested?
