I thought the same thing, but the REAL danger for him is in the civil courts. They will prove that had the dad just run inside, this poor perp would still be alive. The dad was intent on doing the deceased harm. ONeal chased him down and killed him, on purpose. The perp, afterall, didn't intend to KILL Oneal, just rob him. The perps family will win a handsome civil reward in negotiation.

With all due respect, I heartily disagree with your assessment. The perps were parked a few doors down laying in wait. This would constitute premeditation. They used a gun in the crime of robbery, which would pose a clear threat to the life of the victim.
This guy will not be charged, and should receive a mayoral commendation for citizen bravery! (IMO)

He definitely needs a good lawyer but I doubt the perps family wins if he gets one. The perp shoved a gun in his face and threatened to RAPE his daughters.
With the daughters sitting in the courtroom it would be almost impossible for any jury to find in favor of the perps family.
Especially if the jury includes several fathers who have daughters.
