I imagine if this judge was caught with drugs and had to face another judge, he would heed the warning to turn off his cell phone in that judge's presence. So yes, if this judge did the same thing in another judges courtroom he would deserve the same punishment, otherwise I fully disagree with your position.

This has nothing to do with anything. The individual told the judge she thought she had turned her cell phone off. For crying out loud.
This has happened to me at least a dozen times. The buttons are so small, and sometimes if you don't fully depress the off button the damn thing comes back on or fails to shut off.
The tax paid judged is drunk with power and should be REMOVED!
