I would suggest you seek additional legal aid as well -any lawyers here? I would think that you could have got it thrown out for several reasons -dismissed up front without discovery based upon your reply to his 'allegations' -are you representing yourself?

You can't get a case dismissed merely be offering a different version of events, regardless of how persuasive or logical your version is, or how much evidence you have supporting you. That's what juries are for.
