There is a provision of the Connecticut General Statutes and (I believe) of the Connecticut Practice Book that provides that, upon motion (and perhaps a revision of your answer to the complaint) you may ask the trial judge to make a determination that the action against you is frivolous. If the judge so rules, you need not prove liability against the Rev. Mr. "Noisy" and his counsel but merely need a hearing in damages as to how much each shall pay to you and to Tom. I cannot observe as to the adviseability but your attorney can.
