If they are going to charge that guy, they would have to charge all the old marines from the Pacific War. For them, the battle wasn't over until the dead had been shot again, just to be sure, and for precisely the same reason this marine did what he did.
The legalities should be easy. The witnesses will just testify that the person was, indeed, dead. No harm, no foul.
