IF he's found guilty, will the conviction hold up on appeal? Personally, I have my doubts.
Yes, it will hold up.
I doubt it. Three jurors bounced all appear to have been leaning to acquittal. That screams overturn on appeal.
Not to mention that the final juror was replaced by someone with personal ties to both victim and accused.
I haven't followed the trial too much, but what I've seen from the prosecution has been less than impressive. I think he did it, but it's a hunch, not based on the case. I'd have to go not guilty if I were on the jury. (CA prosecutors are god-awful)
I'll say split verdict: Guilty 2nd degree for Scott. Not guilty on the baby.
