Tribe lobbied Kennedy face-to-face when Roe vs. Wade was up for consideration -- in Vienna, doing an end-around on U.S. law if not U.S. legal ethics. Got his vote, too.
Kennedy and O'Connor swing like a rusty gate. Souter got recruited by the Dark Side at Pamela Harriman's social soiree's, turned into a Thurgood Marshall clone.
Until I see it and have to eat my words, I'll warrant that Castle Bush couldn't nominate a conservative, strict-constructionist justice to save their lives. It just isn't in them.

IMHO...I think they could nominate them...but it's gonna depend on who is the Chair of the Senate Judiciary starting in January as to whether they get approved.
