They will be sued and they will lose. They can't discriminate.
I think if you are going to allow domestic partner benefits you have to do it without restricting it to partners who are in a sexual relationship. If the definition of family is indeed to be broadened, why should it only include partners who have sex with each other? Why not a family like the old show "Kate and Allie" or the new show "Two and a Half Men"?
