A former secretary of the Navy is urging Sen. John Kerry to open up his personnel files to resolve the question of whether the Democratic presidential nominee received a less-than-honorable discharge from the Navy.

William Middendorf, the Navy chief from 1974 to 1977, told WorldNetDaily today that Kerry, who began inactive reserve status in 1972, would have been issued a document three years later either for a reserve reaffiliation or a separation discharge.

An "honorable discharge" from 1978 appears on the Kerry campaign's website, but a Navy lawyer who served under Middendorf believes that document is a substitute for one that would have been issued in 1975.

However, no such document can be found among the records Kerry has made available.

"I should think it would be in his interest to open up the files, to clear up any misunderstanding," said Middendorf, who later served as ambassador to the Netherlands, European Union and Organization of American States.

Middendorf said he cannot comment specifically on any action taken on Kerry, because he is barred, under the 1974 Privacy Act, from discussing personnel matters.

However, he enthusiastically vouches for the character of Mark Sullivan, who formed the basis for a story today in the New York Sun by Thomas Lipscomb, the first to report discrepancies in Kerry's discharge record.

Sullivan, who served in the secretary of the Navy's office in the Judge Advocate General Corps Reserve between 1975 and 1977, says the "honorable discharge" on the Kerry website appears to be a Carter administration substitute for an original action expunged from Kerry's record, Lipscomb reported.

Asked by WorldNetDaily to address Sullivan's findings, Middendorf cited the Privacy Act.

"I shouldn't comment other than to say I respect Mark Sullivan as one of the finest Navy officers we had."

The Kerry campaign has insisted that all of the senator's Navy records have been released, with the exception of medical papers, but the Washington Post and others have reported at least 100 pages are still under wraps. Kerry would need to file a Standard Form 180 to grant permission for full release of his records.

If Kerry received something other than an honorable discharge, it likely was related to his anti-war activities while a member of the Navy reserve, says Jerome Corsi, a specialist on the anti-war movement and co-author of best-seller "Unfit for Command."

"We've been arguing that Kerry's cooperation with the enemy throughout the Vietnam War was widely known by the intelligence community," Corsi told WND.

Corsi believes this is the reason the discharge is not on the campaign website.

"If he didn't have reason to hide anything, he would have released it," Corsi said.

As WorldNetDaily reported last week, two newly unearthed documents captured by U.S. troops during the Vietnam War provide the first concrete evidence that Hanoi's communist regime directing Kerry's group Vietnam Veterans Against the War.

A third document provides more context, showing that Kerry's 1971 press conference calling on President Nixon to accept the seven-point plan presented by Viet Cong leader Madame Binh aligned with Hanoi's carefully crafted agenda.

Why didn't this SECNAV make his appeal two weeks ago. The MSM is going to iggy this altogether.

This comes out on November 1?!? It might as well have come out on Christmas Day for all the good it will do. Why wasn't Bush hammering this home at his campaign stops? Why didn't he hold up a copy of the Form 180 he signed and challenge Kerry to do the same thing?

Yeah what is the point now? Unless....this thing gets tied up in the courts (the election) and then they bring it out to discredit him? Maybe they are waiting to see how things turn out, if the President wins without problem, they won't need to do anything, but if its a litigation thing, could this maybe then be brought out?

They have been trying to get people to listen to them...only no one has. WHY DO YOU THIK THE TROOPS SUPPORT PRESIDENT BUSH 4/1 OVER SENATOR KERRY? Blame the media for waiting on this. We've long ago reached the conclusion that this is too little too late, but may have traction after 11/02. After that, several questions arise:
1) Can action be taken to unseat a Senator under appropriate constitutional grounds for 'aid and comfort'?
2) Where does that action take place?
3) What are the subpoena powers that would allow an exposure of records?
4) Who has the guts to press any of this?

Why should it matter1 day 2 days 10 days. His records should have been opened before this by the courts or the demand of the Congress!!

We are not talking about a complete unknown here! This is John Kerry, and Senator or not he is not above the LAW! The constution states that he could not hold any office, under the conditions of his first discharge. How can a record that shows he demonstrated in with the coordination of a Hostile Foreign Government be "EXPUNGED" !!!! By Anyone. Once you are convicted of MURDER, can your records be EXPUNGED?? ! I don't think so. So would someone please explain to me how TREASON can be EXPUNGED ??!!

Probably because the White House has been leaning on
everyone having first hand knowledge of the truth.
Kerry is a more beatable candidate than one to-be-named-
later, should Kerry have to step down.

Because the Bush position is that anything prior to Kerry's
first political office is off limits to the Bush campaign.

Because he didn't. He apparently just issued a verbal
Executive Order having the same effect (which is why the
FOIA suits were allowed).

John Kerry is scared to death of 78 year old Bud Day (Air Force pilot (Iowa National Guard), Hanoi Hilton prisoner, Congressional Medal of Honor bearer). Kerry doesn't have the stones to sit across the table from an elderly man from Shalimar, Florida

How could we expect him to face down our worst enemies?

I did some checking "Kerry's discharge + 2003," and
found the same comments as I see on here today: If it's true, why isn't anyone else talking about it? Then it's tossed aside.

One would think the public would take the members of our military a little more seriously during a time of war when they are fighting to keep all of us alive.

I believe according to the 14th amendment it would/could be an issue:

Amendment XIV

Section 3.
[No person shall be a Senator or Representative in Congress, or elector of President and Vice President, or hold any office, civil or military, under the United States, or under any State, who, having previously taken an oath, as a member of Congress, or as an officer of the United States, or as a member of any State legislature, or as an executive or judicial officer of any State, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof. But Congress may by a vote of two-thirds of each House, remove such disability.]

Perhaps the GOP is using this as an ace in the hole if they need it "post" election if the election goes to the Supreme Court once again.

God willing, it never comes to this. BUT:

Wouldn't it be awesome to see the case dismissed on the first day of deliberations as John Kerry is Constitutional ineligible to hold the office of President of the United States!
It would shut the RATS up once and for all.
