To help clarify...
1. The obtain a CDL, a person must consent to search, without cause.
2. To obtain a DOT authority to operate, you must consent to search, without cause.
3. The controlling authority of the DOT, IS NOT limited to commercial vehicles.
4. The size, weight or, towing capacity for the vehicle in question is no longer the determining factor in whether or not it falls under the DOT for regulation and enforcement.
5. The intend use of the vehicle is what places it under the regulations of CFR 49 37x.xxx, this can mean your car or pickup truck is subject to weighing, logbook, hours of service, etc regulations.
To further help all here...what is happening in TN/KY at the moment IS NOT normal or customary, by any means. They are looking for something.
I, nor any of my drivers, have ever been stopped, in the manner described, for any reason other than a specific search for a specific item/person/vehicle, etc. In fact, the only out-of-the ordinary stops we have encountered is the U.S. Marshall, looking for drugs, and Immigration, looking for illegals. Period.
That's not to say we have not been asked to allow vehicle inspections at the weigh/inspection stations, we have. But, usually, we compromise or outright refuse.
