Imus and radio host Jay Severin talk about the confirmation hearings of Judge John Roberts to become Chief Justice of the United States.
Imus: "He's gonna breeze through isn't he?"
Jay Severin: "Oh yeah. Well this has become, for all the interesting drama that this is, that because of Roberts inevitability and because it's a Conservative for Conservative trade on the court. Meaning, one Conservative seat for another, Roberts for Rehnquist, this process while historic, important and interesting has merely become an exhibition game compared to the O'Connor seat, because in several hours or days, the President is going to name the judge that's going to fill the O'Connor seat which is going to turn 5-4 decisions, these monumental 5-4 decisions into 6-3 decisions, now that is going to be Armageddon, if Bush picks a Conservative. And a lot of people, including me regard that as a big if. A lot of people wonder whether Bush really in his heart wants a more Conservative court in his legacy and whether he has the stomach or political capital right now for the kind of fight that would be necessary to get one on there, because this is nothing compared to what they'll do to the O'Connor seat."
Imus: "Well he doesn't have the political capital."
Jay Severin: "He has none, he's overdrawn."
