Peterson Undergoes Mock Cross-Examination With Trial Analyst Cardoza
REDWOOD CITY, Calif. -- Scott Peterson is being prepared by his defense team to possibly take the witness stand in his own defense, according to a Bay Area attorney who said today he spent several hours questioning Scott Peterson over the last week at the behest of Peterson's defense team.
Former Alameda County prosecutor Michael Cardoza has been providing legal analysis of the Scott Peterson double murder trial for a number of news organizations since early this year. He was approached last week by defense attorney Mark Geragos and asked to simulate a prosecutor and cross-examine Peterson. Cardoza cross-examined Peterson for an extended period on two separate occasions, once last week and once on Sunday.
"It was hours both days," Cardoza said.
Cardoza would not comment on what transpired during the two sessions, citing attorney confidentiality rules. He did say that any competent defense attorney will not make any decision about putting a defendant on the witness stand until the end of trial........
Defense Begins Presenting Its Case in Peterson Murder Trial
KCBS/AP) - The defense in the Scott Peterson double murder trial began presenting its case Monday, five months after opening statements were given. KCBS reporter Bob Melrose says the first person to testify was defense investigator Carl Jensen, who said he visited a hotel in Carmel where the Petersons had vacationed a week before Laci disappeared.
Jensen told the court the walk the couple took along the waterfront is more than 14-hundred feet and included a steep downhill grade. Witnesses have said the couple walked to the beach from the hotel.
This is important because it contradicts a key prosecution theory that Laci Peterson had stopped walking for exercise weeks before she vanished. One defense theory is that Laci was walking her dog when she was kidnapped. Peterson's attorneys have previously shown jurors a photograph of Scott and Laci Peterson on a beach during that trip. <.........

REDWOOD CITY, California (CNN) -- The judge in Scott Peterson's murder trial refused to dismiss the charges against him Monday, saying there is sufficient evidence to continue the proceedings.
The request for dismissal came from defense attorney Mark Geragos, who argued there is insufficient evidence against his 31-year-old client, who is accused of killing his pregnant wife and unborn son. Their bodies washed ashore separately along San Francisco Bay in April 2003.

Legal analyst and former Alameda County prosecutor Michael Cardoza announced Monday that he spent hours on Sunday and a day last week with Peterson to help the defendant's attorney assess how he would do under intense questioning.
Cardoza said he conducted the mock cross-examination at the defense team's request. Aside from saying it was held in an attorney conference room at the Redwood City jail, he would not disclose anything about the dry run or if defense lawyers Mark Geragos and Pat Harris were seriously considering having Peterson testify. .......

Prosecutors have claimed Peterson made five cement anchors, one of which was found in the boat authorities allege he used to dispose of his pregnant wife Laci's body. The other four, which they allege he used to sink her body in San Francisco Bay, have not been found.......

Defense tries chipping away at concrete evidence
Scott Peterson's defense team launched its highly anticipated case this morning, starting with witnesses who collected and analyzed pieces of concrete from Peterson's driveway.
Prosecutors contend Peterson made several homemade concrete anchors and used all but one to weigh down his wife Laci's body when he allegedly dumped her in the San Francisco Bay. Police found only one anchor, and believe he used remaining cement on other anchors.
Peterson said he used the cement left over from making the one anchor for improvements on his driveway........

Expert: Scott Peterson did not stand to profit from wife's murder
REDWOOD CITY, Calif. Scott Peterson had no money motive to kill his pregnant wife and unborn son, a financial expert testified Monday, the first day of the fertilizer salesman's defense.
"From a financial standpoint, he would've been better off if they were alive," forensic accountant Martin Laffer told jurors at Peterson's capital trial.
He said the murders of defendant's wife, Laci, and her unborn son meant Peterson would not share in an estimated $160,000 inheritance his 27-year-old spouse was poised to receive on her 30th birthday. Instead, that money will go to her relatives, Laffer said.
Prosecutors did not commit to one particular motive for the murders during their 19-week case, instead hinting at several possible reasons, including Peterson's affair with Amber Frey, his alleged ambivalence about fatherhood and his rising debts at work and at home at the time of his wife's Dec. 24, 2002, disappearance.

Jury starts hearing defense witnesses
Scott Peterson would not have benefited financially from murdering his wife and the couple's unborn baby, and in fact, their deaths will prevent him from coming into a great deal of money, a forensic accountant testified Monday.
After Judge Alfred Delucchi refused a defense request to dismiss the charges against Peterson on Monday morning, defense lawyers called their first witnesses in the double-murder case and the trial resumed after a recess of more than a week.
It was the beginning of the defense's long-anticipated case. For four months, as prosecutors presented their case, defense lawyers Mark Geragos and Pat Harris tried to hammer over and over again that Modesto police and prosecutors were so intent on getting Peterson that they cut corners in their investigation and ignored other suspects to win a conviction. They even used fuzzy math, Martin Laffer, a former Internal Revenue Service criminal investigator, said Monday.

Impostor, or just savvy investigator?
U.S. marshals are upset that a private investigator searching for clues in Laci Peterson's murder may have passed himself off as one of them. "If they're doing that and get caught, we want them prosecuted," spokesman Donald Hines said Friday from his Washington, D.C., office.
Sam Newnam, owner of The Pawn Shop in Modesto, said Friday that Scott Bernstein poked around his store in late June or early July. Around his neck, Bernstein wore a leather holder with a metal star badge reading "New York Fugitive Task Force," Newnam said.
"He led me to believe he was doing a nationwide sting operation on thieves," Newnam said. "I thought to myself, why is somebody on a fugitive task force talking about a sting operation?"
Bernstein's Fresno attorney denies that the private investigator tried to pass himself off as an officer of the law........

REDWOOD CITY Scott Peterson's legal team opened his defense presentation Monday with experts who indicated that the Modesto man told the truth about concrete work and wasn't in financial trouble.
Another witness, a security expert, said vandalism prompted him to urge Peterson to get a private mailbox a far cry from authorities' portrayal of the box as a way to secretly get mail from his lover.
Before the defense began calling witnesses, Judge Alfred Delucchi refused to dismiss double-murder charges against the fertilizer salesman.
Los Angeles attorney Mark Geragos called four witnesses on the defense's first day since opening statements began June 1. One indirectly confirmed that Stanislaus County taxpayers will foot his $15,000 bill for expert testimony. .........

Top legal eagle Michael Cardoza yesterday acknowledged that he donned the role of a tough prosecutor in the potentially crucial role-play, which was orchestrated by Peterson's lawyer, Mark Geragos.
Cardoza a former Alameda County prosecutor and now frequent TV commentator on the case said he talked briefly with Peterson about a week ago, then met with him for several hours Sunday, grilling him with rapid-fire questions as Geragos listened.......

I guarantee you that the mock cross-exam was done not to prepare Peterson for taking the stand, but rather, to demonstrate to Peterson that taking the stand in his own defense is an incredibly stupid idea.
