The sexual harassment suit was filed so close to BoR's suit that it seems that possibly BoR knew what was coming and went with the doctrine of preemption.
If they were trying to get money out of him it would not have made sense to file on him until they knew he would not go for it, and there was not much time between the filings so it would be hard to have filed the sexual harassment suit that fast.
