The only known incident in Vietnam that may have affected his discharge status would be the anecdotal retelling of his refusal to raze an identified V.C.-held village to the ground.
I don't think he's ever shied away from that story, though. Anyway, I guess we'll find out come 0600. It's very, very hard to punish a servicemember already in the Individual Ready Reserve (IRR) for acts he committed while in a non-recalled to active duty status.
Even John Walker (who was nabbed along with his son Michael) for selling secrets to the Soviets back in '85, and who was drawing retired pay, even, wasn't recalled to active duty to stand a military court martial, though the Navy could have done it, if they had been of a mind to (he was a retired Navy Chief Warrant Officer, holding an officer designator that delineated him as being in the Navy but on the Retired List....I hold a designator as being a retired Lieutenant Commander on the Retired List, but I've never seen anyone out for more than 5 years who has ever been recalled to stand trial).
