No adult seemed to be in charge of mu Fraternity. We drank. We drank too much. So did non greeks... And we pushed the envelope of drinking. A crime? Perhaps, but I think it was youth.

BTW, the 'hazing' in my fraternity's hell week consisted of thoroughly cleaning, rehabilitating and painting the common areas of the fraternity house, including carpet steaming and light finish carpentry. We drank, but no one forced anyone to drink anything. Most fraternities I know are like that.
Well no actually. In my salad days, admittedly rather a while ago, we handled our own money, ran our own kitchen and dealt with A/R & A/P issues without input from the school.
If, as periodically happened a pledge or brother got out of hand the officers and the brothers squared the issue away internally.
The issue of "binge drinking" was not an issue when I was in school ('65-'69) although in a mens school in So-west Pa. drinking was the norm and some could really pack it away. No body ever died that way though.

Frats should not be banned, but this has to be some form of crime. Maybe a form of manslaughter.
I'm not a tee-totaller, but we've had too many generations of people laughing off bing-drinking while thousands of young people die in car wrecks or idiocy like this.
No, they didn't want to kill him. But this kind of reckless behavior shouldn't be tolerated. Let's wake up and stop it.
