Scott Peterson's Prosecutors Expect To Wrap-Up Thursday

A Modesto police detective is headed back to the stand Monday, to continue cross examination by Scott Peterson's lawyer Mark Geragos.

Detective Craig Grogan has spent a week explaining why authorities think Peterson is the only person who could have killed his pregnant wife, Laci.

Under cross-examination last week, Grogan acknowledged Peterson has no prior criminal record and had never laid a hand on Laci before she was reported missing Christmas Eve 2002.

Prosecution takes charge

Juries like prosecutors who are confident, composed and direct -- the very traits the prosecution in the Scott Peterson trial has been accused by legal analysts of, well, lacking.

Juries also like their police officers to sound sincere -- not too smug.

Enter Birgit Fladager and Craig Grogan.

Their one-two punch this week seems to have shifted the momentum of the trial heading into the end of the prosecution case.

Fladager is Stanislaus County's chief.......

Peterson defense continues cross-examination of lead detective

REDWOOD CITY, Calif. - A Modesto police detective who has spent a week recounting why authorities maintain Scott Peterson is the only person who could have killed his pregnant wife returns to the witness stand Monday to be questioned by a defense set on showing that police honed in on Peterson too hastily.

At the onset of his cross-examination Thursday, defense lawyer Mark Geragos quickly got Detective Craig Grogan to acknowledge that Peterson had no prior criminal history and had never laid a hand on his wife, Laci, before she was reported missing on Dec. 24, 2002.

The detective also agreed that as the investigation unfolded, the Petersons' friends were all very supportive of the 31-year-old former fertilizer salesman.

As the cross-examination of Grogan goes into its second day, Geragos is likely to point out for jurors all the evidence police couldn’t find that would implicate Peterson in the killings — no murder weapon, no crime scene, no cause of death and no direct witnesses..........

A chief deputy tries to save case 1-21-2

PROSECUTORS HAVE BEEN under the harsh glare of legal pundits, reporters and armchair lawyers for months as they unfurl their double-murder case against Scott Peterson.

Critics have said there is no case and that prosecutors have neither hope nor prayer of pulling out a win. As actors in a real-life legal drama, their story was analogous to the Biblical tale of David and Goliath, they have said, adding that in this go-round David would lose for sure.

But perhaps the tables were turned this week as once again Birgit Fladager, a chief deputy district attorney for Stanislaus County, took the........

<"Delucchi approved a left-handed swearing in with a smile and a nod.

OBJECTION! While Geragos and the defense offered up the most objections this week, it was prosecutors who squeaked out a victory. Judge Delucchi sustained 57.1 percent of their 21 objections.

Geragos & Co. rang up a win tally of 56.3 percent, or 27 of 48 objections raised.

The trial resumes Monday">

Looks like Distaso, Harris, and Fladager (and the great police officers) are finally going to see the frog boil. The frog (Geragos) is only beginning to realize it. He thought he'd just found a nice pond to sit in.

Morning rb!
I was just looking at something that may be interesting to anyone who doubts a conviction can be possible in a circumstantial evidence case. (which there is a load of against SP)

Birgit is an odd name...wonder if somehow Brigit was misspelled???

Heh heh heh--she already has, Jackie!

Her name gave me fits for a while. I thought it was Brigit, too. But apparently it's not!

That's a good cite you posted, about convictions with no bodies. Sante Kimes comes to mind.

I mean, if someone wants to talk circumstantial, where was the direct evidence that Ted Bundy murdered Kimberly Leach (his 12-yr-old victim)? No one SAW him kill her. Therefore, virtually all the evidence in that case was circumstantial. (Someone claimed to have seen him grabbing her by the arm--but they did NOT see him kill her.) Bundy got THE CHAIR because of the circumstantial evidence in that case.

Of course, there was his sorority house case, too. There was an eyewitness who saw a man's profile in the shadows, entering the sorority house. That's not the same as an eyewitness who would have actually seen him beating those girls in the head as they lay in their beds. So the sorority case was about 99% circumstantial, too.

I'm watching the CTV shows today. Interesting that those who are right there in the Courtroom say that Geragos has pretty much lost the fire in his belly.!! Kimberly GN said that she was in the Courtroom this morning and she got a look at the Jury and she said "I feel a whole lot better now", "This is a good jury"!! And we certainly know where Kimberely is coming from. Even the Defense Attny that Vinny has on with him keeps saying, "If I was Geragos about now, I'd cry". Then she said after they played the Gloria Gomez video, "She said that's terrible, it's so obvious he's just lying through his teeth". Beth Karas stated that Geragos pointed out that Brent Rocha, Amy Rocha and Sharon had all referrd to Laci in the past tense BUT Scott was the ONLY one who quickly corrected himself. The others were just talking and likely never even noticed that they said that. It's going baaaaaaaad for Geragos right now. Also, Grogan is just so honest and believable on the stand. The Jury likes him.

Yes, I heard some of that. I heard them say, Beth, what surprises are there since your last update? And Beth said, well, it turns out that BRENT also referred to Laci in the past tense! (We case followers already knew that, of course.)

At that point I looked at the TV and said, Well, WHAT are we waiting for??! I hear sirens. Here comes the SWAT team to arrest BRENT ROCHA, right there in the courtroom. Talk about your Perry Mason moments...

Um, Mr. Geragos, Brent Rocha lives in some town that's the better part of 100 miles away from Modesto--at least, that's my dim memory from his testimony. And where was Brent on Dec. 23-24, 2003? Surprise! He was in that town, at least an hour's drive from where Laci was--right where he was supposed to be.

Even more important was what you said: When Brent said "she WAS", we didn't hear him immediately start hemming and hawing and quickly correcting himself to the present tense. Nor did we hear that when SHARON and AMY, Geragos' other "suspects", spoke of Laci in the past tense. (Sharon as a suspect--what planet does this Geragos idiot live on??)

I just love seeing Geragos desperate. Burn, Geragos, burn! (And I mean that in the nicest possible way.)

No kidding. The IMPORTANT part of these statements is that the ONE who corrected himself was the one who was CONSCIOUSLY lying!!

Hi CO,
Don't you just love it when you hear Geragross was pissed off in court ? Kinda gives you the idea he is playing "catch up football" and he isnt the cocky arrogant schnook like his client these days ? With Lee Peterson sitting there watching his performance, do you think he is getting his moneys worth ? and if it is a hung jury, will he have another mil for Gergies new yacht or limo ? or will the parents decide he isnt worth the bucks and will try to get him to cop to a lesser plea now that they know what a lying SOB their kid is, and is probably guilty ?
