How about some Federalism then, Senator Ted Kennedy has HIS so called "hate crimes" bill known as the Local law enforcement Enhancement Act (S. 966). Under the Kennedy bill every crime that has the potential to be a "hate" crime WILL be Federalized and Federal prosecutors WILL freely intervene in local law enforcement. This bill was offered in 1997, 1999, 2001, and 2003, sounds like it runs in the family...I can hear uncle Ted now saying "I'll be back".

That said, there is a huge difference between a state government, which has plenary power, passing a law, and the federal government, which has enumerated powers, passing a law regarding which it has no claim to jurisdiction.
