He's not ordering the Commander-in-Chief to do anything. He's ordering a Presidential candidate to do something. There's a world of difference. Can the judge make this order? I'll leave that one up to the legal experts. I don't have the background knowledge in this area of law to say one way or another.

Each government agency has its own FOIA requirements and exceptions; they're probably broadly alike, but they should be requested under the proper provision of the USC. It wouldn't have gone to court unless the request to the NG or the Pentagon or whatever had been refused.

He's ordering the Pentagon to produce the documents. Bush has already,long ago, instructed them to do the same.
