Obviously the "is is" defense is alive and well.
I try not to follow the Peterson case, but suppose new evidence were to turn up at the house, whihc has already been searched and searched again. Suppose it's dead-bang evidence. Would anyone buy it, even if it turned out to be "accurate"?
What if there wree a fake memo supporting the statements of the Swiftees. Do you think DNCBS would take it at face value?
That's why "fake but accurate" isn't good enough.
