Actually, it may be possible to get a court to decide. Such an offer would be enforceable. If it is not enforceable, it would be possible to have a good lawyer team expose it as a false offer.

You just put your finger on the key to the whole issue.
MSM takes Kerry's word for it, without documents, despite
multiple eyewitnesses in disagreement, and the changes in
his own story.
MSM doubts Bush's word, even though corroborated through
multiple INDEPENDENT documents and witnesses.
