Malpractice losses (jury awards) appear to be the primary driver behind the rising cost of malpractice insurance (U.S. General Accounting Office, June 2003). Research also shows that the cost of malpractice insurance is 17.1 percent lower in states with caps on malpractice awards (Health Affairs, Jan. 2004).
