Kerry was never assigned to a unit and was not being paid. He had no obligation to drill. It really doesn't advance the cause to throw around treason charges. The man is just very, very, very wrong. On the other hand, if the meetings with the North Vietnamese can be documented, Kerry would have violated a very specific statute against citizens negotiating with foreign powers.
That isn't how it works. It doesn't matter if you're not assigned to a unit or not being paid, you are still under contractual obligations, and fall under the UCMJ. As far as the documentation goes for meeting with Vietnamese people, that HAS been documented in several places. He has even admitted to it.
