Sadly that right does not exist. The Supreme Court knocked that down. I'm not happy about that decision, but that's the way it is for now.

These people are not being held for not identifying themselves, but on other charges (apparently assault, resisting arrest etc.). The judge should not allow bail untill their identities are established. They could be wanted on other charges.
