O'Neill Dares Kerry: 'Sue Me'

Swiftboat Veterans for the Truth spokesman John O'Neill dared Sen. John Kerry on Sunday to sue him for libel if, as Kerry's presidential campaign maintains, key claims in O'Neill's book "Unifit for Command" are not true.

"I invite him to sue me for libel," O'Neill, who co-authored the overnight bestseller with Jerome Corsi, told WABC Radio's Monica Crowley. "If he was actually in Cambodia on Christmas Eve and Christmas Day he should sue me. If, in fact, those other five [Swift]boats, on March the 13, [1969], if they all fled like he did, instead of staying like he knows they did, he should sue me."

O'Neill continued:

"If he didn't wound himself with a grenade - causing sort of a rice-fanny wound - and then reported it to the Navy as a water mine - if he didn't do that on March 13th should sue me."

O'Neill issued the challenge after noting that Kerry's campaign has gone to extraordinary lengths to supress the information in "Unfit for Command."

"On our first [Swiftvet] ad, he had two huge lawfirms send letters to every [TV] station, threatening to sue the stations themselves" if they ran the ad, the former Swiftboat commander told Crowley.

"The next thing he did was challenge the book's publisher, Regnery, indicating he would sue them if they continued printing the book," he added.

The bestselling author said that while Regnery declined to stop printing "Unfit," it offered to republish Kerry's 1971 book "The New Soldier," which chronicles the top Democrat's anti-war protests with a group bankrolled by Jane Fonda.

Kerry has declined to have "New Solidier" republished over the years and reportedly bought up most of the available copies in 1972, after his opponent in a congressional race used it to paint him as anti-American.

I am not a lawyer, but if Kerry sues, O'Neill will immediately file a counter suit. If Kerry wins the election, he will be faced with a Clinton-like problem of a civil suit hanging over him, in which he could be compelled to testify under oath and produce documents. If Kerry initiates the litigation, my guess is that it would make it more difficult for a judge to allow him to delay judgment day.

There is no way that Kerry can afford to take a chance on any civil litigation involving O'Neill, particularly when he has no chance of prevailing.

Even if a handful of Swiftvets had signed false affidavits, Kerry would have to prove by a preponderance of evidence that O'Neill knew that some of the claims were false. O'Neill has been very careful to require the Swiftvets to sign sworn affidavits before he published their statements in his book.

O'Neill knew what a litigious, lying weasel Kerry is when he decided to expose him as such.

He won't sue. Discovery can start the minute a judge accepts the case. ALL of Kerry's records will be up for grabs.

That's good to know. He'll want to keep that from happening.

Kerry is sooooooo toast!

Let's not get too overconfident. Kerry has the force of the mainstream media on his side. All the stuff we know about him - the lies, the flipflops - is not being reported, and Joe Sixpack doesn't have a clue. He knows only what he reads from the AP dispatches or on the network news, and we all know that those sources report nothing negative about Kerry. It's up to us to spread the word about the Vietnam lies.

I think there's a basic principle in the law known as "the truth is an absolute defense", so O'Neill clearly has nothing to worry about.

Exactly. It calls Kerry's bluff and compels Kerry, not O'Neil, put up or shut up. John Kery has built his life on less than the truth. To shine the light of compelled scrutiny on Kerrys actual life, will only confirm the validity of the title of; "Unfit for Command".

So when are the Swift Vets going to use Kerry's book to paint him as anti-American?

I have to say, the Swift Boat Vets' work thus far has been mediocre. I think they really missed some opportunities with the 2nd ad, the POW one. They gave no context for Kerry's testimony.

They should have said something about Kerry leaving Vietnam after 4 months to join Jane Fonda's radical left-wing "Vietnam Vets Against the War" Organisation.
They didn't.

They should have mentioned that -- as John McCain said (perhaps even using audio of him saying it, if it exists) -- Kerry's testimony was used by the Communists as justification for torturing POWs.
They didn't.

They should have mentioned how Vietnam Vets were spit on when they returned home and were called "baby killers", in large part due to John Kerry's testimony.
They didn't.

I really feel that the POW ad is softball. The little bit of information it provides assumes the viewer already knows the whole story (if that was the case then there would be no need for the ad), then it offers some very abstract and watered-down criticisms of Kerry's testimony. I hope they do better in their next phase. John O'neill says he'll do anything to keep Kerry from becoming the next President. Let's see it then.

The last thing the DEMOC party wants JeFnK to do is sue and have to sign his Form 180 to release into evidence all of his records. Bad enough what we have from the public archives. Add the complete military records plus the evidence that the SBVT have and ----- no O'Neil telling JeFnK to sue him is the best thing as it is the one thing that the left can't do and win at.

I also think Kerry will sue....if the charges are left unanswered, everyone will assume they are true.

I think the damage has been done though...the five million Vietnam vets in the country are rethinking their votes.

Kerry will avoid the lawsuit as it is just an empty threat. If he sues, he might need to sign form 180 and we wouldn't want that now would we?
