No, they just mention his words. They do not endorse or oppose the candidate. Under CFR, its perfectly legal You need to look at the FEC FAW page on the CFR law. They indicate that express support or opposition is not required to be in violation. If the purpose of the ad is to oppose a candidate, and that candidate is in any way identified, the ad would be in violation of the law, as interpreted by the FEC.

It's 30 years old, why dredge up the past," Thus the next installment will tell how he (and McCain) suppressed evidence of live Vietnam War POWs in order to "normalize" relations with Vietnam. That was much more recent, just over 10 years ago, IIRC.

True, but my understanding that to be illegal the ad would have to endorse a candidate...If you really look at the ad it never even mentions an election...let alone naming a candidate. Not according to the FEC website. If the purpose of the ad is clearly to "affect a federal election", and he cannidate is clearly identified (a picture is surely good enough) then it's banned. (after Sept 3rd that is, not now) The First Amendment not withstanding.
