I read on another thread what I think is the perfect response to this illogic. If someone sees a car accident, would you ignore their testimony because they were not in the car.

Depends. If they say "the driver looked distracted as he was playing around with the radio" then yes. If they say "He looked distracted as he was probably thinking about XYZ" then no.
