HUMAN EVENTS has obtained a copy of a letter which lawyers for the Democratic National Committee and John Kerry have sent to television station managers attempting to suppress the blistering anti-Kerry TV spot created by the Swift Boat Veterans for Truth and first reported here on HumanEventsOnline.com.
The letter claims the ad is "false" and "libelous" and suggests, in not-so-subtle terms, that TV stations should use their "legal authority" to refuse any requests for advertising airtime, stating that "because your station has this freedom [to refuse the ad], and because it is not a 'use' of your facilities by a clearly identified candidate, your station is responsible for the false and libelous charges made by this sponsor" (emphasis added).
As their first piece of evidence of the ad's supposed lies, the DNC/Kerry lawyers claim that the veterans in the ad "purport to have served on Senator Kerry's SWIFT Boat in Vietnam" but, "in fact, not a single one of the men who pretend to have served with Senator Kerry was actually a crewmate of Senator Kerry's." The problem is that none of these men claimed to have served on Kerry's SWIFT Boat. They simply said they "served with John Kerry" -- and they did.
The letter goes on to make several more misleading statements about the advertisement, in an attempt to protect Kerry's "war hero" record. Read the full text below.
Those were not the "crew of his command", meaning the enlisted sailors serving on one or both of the two PCFs he commanded. (the only officer was the OIC, officer in charge, of the boat). They were fellow OICs from the other boats and staff of the PCF division.
That's a might big IF. Mighty big indeed. Bigger than Kerry's ego, and approaching that of his wife.

No it's not a shakedown..this is a preview of the "election challenge" if Kerry doesn't "win". Reportedly, Kerry is going to apply the Goreon Strategy to take the election to the courts. Kerry has retained dozens if not hundreds of attorneys for election night.
What can individual lawyers do when they know of a violation of professional ethics? Do they likewise have to have standing to pursue it?
Club for Growth just posted a letter the Kerry Campaign is sending to stations threatening them if they run Club For Growth Ads.

Good thinking. We need to push this through a solid grassroots effort.
It makes a big deal out of Dr. Letson not treating Kerry. But I thought that was the whole point. As I understand it, there is no medical officer report supporting award of the first Purple Heart, which supposedly is a prerequisite. All there is is the corpsman scribbled record of applying bacitracin and a bandaid.
Why would a medical officer waste his time writing up a wounded in action report on "applied bacitracin and a bandaid"?
They have an ethical obligation to report it to the bar.
I wonder how well it will work in the middle of a presidential campaign. I sure hope it backfires on them. It seems to me that if it wasn't a stupid move for a politician to sick lawyers on the media, politicians would do it all the time. I guess at worst this tactic is the equivalent of plugging a leak in a dike with your finger.

There's an idea. I bet the file is small enough to fit on one of those small CD-Rs (round or business card sized). Burn a bunch and hand them out like candy.
You got it! At least in part.....The Swift Boat Vets' were getting no where....They had a news conference, they released statements, they signed petitions.....No one paid them a bit of attention.
They release and distribute a pointed controversial ad and all of a sudden everyone want to know who they are, what's going on. ANything milder would have been glossed over too...........
It's possible that the DNC were so busy planning the party that they were a little blindsided by this.....promoting his Nam linked played right into the Swift Boater's hand......or there are some really dumb people at the DNC........
My hats go off to these men...They were and still are HEROES!
