As another pointed out, the purpose here is not to win, but to delay. After Sept. 3rd, the ads can not air regardless of the outcome of any legal action.

The ads cannot run but websites (and emails) will continue to spin this story.
At some point in time, the new media "internet" will fall under FEC control. There is a lot of foreign financing and unregulating donating to fund websites that serve to campaign for/against a candidate.
