SACRAMENTO Moving to capitalize on lingering resentment over legislative efforts to grant driver licenses to undocumented aliens, some Republicans plan to launch a broad initiative campaign aimed at barring those in California illegally from collecting welfare, college scholarships or food stamps.
The measure, targeted for the March 2006 ballot, also would pre-empt any legislation to allow illegal immigrants to gain driver licenses.
Gov. Arnold Schwarzenegger, who persuaded the Legislature to repeal such a law, is negotiating a compromise measure with Sen. Gil Cedillo, D-Los Angeles, but no deal has been struck.
"We have to stop the incentives for coming here illegally. This is the only way to do it. The Legislature cannot be trusted," said Mike Spence, president of the California Republican Assembly, a conservative grass-roots faction of the GOP.
The initiative is a narrowed version of the polarizing Proposition 187 approved by voters in 1994.
The courts and mediation later invalidated much of Proposition 187, allowing children of illegal immigrants to attend school and receive medical care.
Spence said the new initiative would exempt those services required by the courts.
Moderate Republicans have worked to mend seriously damaged relations with Latino voters, many of whom viewed Proposition 187 as a direct attack. A "son of 187" could attract conservatives, but erase GOP gains among Latinos as early as this November's election.
If approved by voters, the initiative would bar undocumented immigrants from collecting retirement, welfare, unemployment or disability checks. They would not qualify for housing subsidies or food stamps. And they would no longer be eligible for cheaper in-state college tuition or receive loans and scholarships.
"This is a time for us to bring our country together and look for ways to build unity, not division," Cedillo said when asked about the initiative.
"Immigrants are not here for services. They're here to work," he said.
Spence said that the state is broke and cannot afford to provide services to those who crossed the border illegally.
"It's more than the driver's license," he said. "We're running deficits."
Spence is expected to be joined by Assemblyman Mark Wyland, R-Del Mar, in unveiling the initiative today in Sacramento. They need about 600,000 signatures of registered voters to put the measure on the ballot.
Spence's group has proven it has the capability to follow through. It collected more than enough signatures on a referendum to overturn a driver-license bill signed by then-Gov. Gray Davis. The referendum was dropped after Davis' recall and Schwarzenegger's historic election. Schwarzenegger repealed the law soon after his election.

Maybe CA is finally waking up and smelling the coffee. The state is on a fiscal train wreck, the roads are crumbling, and the enviro-wackos are prevent new energy startups. Businesses are leaving in droves.
Fine. Then illegal aliens don't need access to: retirement, welfare, unemployment or disability checks, housing subsidies, food stamps, or cheaper in-state college tuition, loans and scholarships.

Attatch a rider to the foriegn aid spending bill in congress that any moneys incured from states by illegals must be paid back to those states out of the money that would go to those countries.

Well it is not okay, and the vast majority of Californians believe it is not okay.
The Save Our License Initiative contains three main provisions, he added. First, the government will not provide any benefits not mandated by federal law. Second, the government will defend this law against any and all legal challenges. Third, individual citizens will be granted the power to sue to compel compliance with the law.
This initiative is about empowering Californians to stand up and do what the legislature will not do, added Assemblyman Mark Wyland. We should not be granting special tax-funded benefits to illegal aliens, period. And in this time of huge budget deficits, there is even more reason to stop the giveaway of our tax dollars.

Now the legislature is trying to pass another version of this. Its time to give the power to the people to once again say no more.
The Save Our License initiative specifically prohibits the government from giving California drivers licenses, government identification cards and in-state college tuition to illegal aliens. In addition, it spells out a list of benefits for which the government would be prohibited from providing to illegals.
The people of California have spoken out strongly on this issue, only to be thwarted by the State in not defending Prop. 187, and by the legislature continuing to award benefits to illegals, added Sen. Dick Mountjoy, one of the authors of Proposition 187.
This measure will force the government to defend it in court through all appeals, he added. Most experts agree that the bulk of Proposition 187 would have been upheld had the state continued to appeal the case, and weve addressed that in this initiative.
More importantly, the new initiative will give power to individual citizens to force the government to comply with the law.
Under this initiative, any citizen in California will have the right to sue their state or local government to ensure compliance with the law, added Spence. That means if a city, like San Francisco, decides to ignore the law, an individual could bring suit to compel the city to follow the law.
In addition, any government official that is willfully disobeying the law could be held personally liable for their actions.
We are very confident of our success with this initiative, noted Spence. We start with a strong and enthusiastic base of supporters. We have financial commitments to help with the paid signature gatherers. And the legislature is keeping the issue in front of everyone with their efforts to pass a new drivers license bill.

Under California law, the Attorney General has fifteen days to review the language and prepare an official Title and Summary. If the Attorney General determines that the initiative may have a fiscal impact, he must forward it for a fiscal review before issuing the Title and Summary.
Once complete, the Attorney General will transmit it the Secretary of State who will record is and start the clock on the signature gathering. Proponents will then have 150 days to gather the necessary signatures.

Prop 187 never prevented citizen children of illegal aliens from attending school or receiving taxpayer-paid medical care. It was intended to restrict free public schooling, medical care, and other public benefits to citizens and legal aliens only; it was supposed to reduce the incentives for foreigners to stay here illegally.
Children of illegal aliens are not always illegal aliens themselves. The longer we wait, the more "anchor babies" there will be. Nonresidents (like illegal aliens) can also attend our public schools by paying tuition, but most do not, and schools usually fail to collect these education fees.
I hope this initiative constitutional amendment petition is successful. The last "save our state" or so-called "son of 187" initiative petition earlier this year failed for lack of signatures.
