Looks like his finger is awfully close to the uniform because you can see -- in the close-up -- where Kerry's finger ends and where the (mirror) frame begins. Sticking a finger that close, even if not touching the person is likely to tick them off, especially if the horse face happens to be named John Kerry.

Looks to me like JF'nK is acting a little aggressive, almost poking the Marine in the chest with his finger.
If I were on a jury of his peers (which I could never be, having been USAF), I would acquit in a heartbeat!
