In Virginia it's illegal to possess burglarious tools, which can mean a flashlight, a screwdriver, sledgehammer, boltcutters, stuff like that.
But then, when you read the cases, the guy was found behind a building in the dead of night in possession of a crowbar, and the building has a big old chip in it, and there is fresh concrete dust on the guy.
In this case, it's the totality of the circumstances, like hiding a rifle inside a computer. His explanations are garbage, only makes it worse for him. And when the jury hears him tell his wife he should have shot the cops, well, he may not go away for a long time, but he'll do time.
Even Johnny Cochran couldn't get him off in Omaha.
