Terry Wesner said a couple of shotguns and a rifle were removed from his home by SWAT Team members after he consented to a search, though officers did not tell him they removed the firearms after they completed their search.... Oshkosh Police Capt. Jay Puestohl said officers dont go into houses without consent or a warrant. He acknowledged consent to search does not necessarily mean officers have consent to remove property.
There's a few things wrong here:
- By the Oshkosh Police Deptartment's own admission, consent to search does not automatically confer consent to remove property.
- Considering there was but one entrance and one exit wound from one shot, there was absolutely, positively NO justification for the seizure of the shotguns.
- Lack of notification of the seizure after a "consent search" ("Consent, or we'll have Miffy here tear off your left arm and Billy here shoot off your right arm.") is theft, plain and simple.

It does if they consider it evidence.
Looks like a Barney Fife dept, but then what do you expect from a corrupt local gov. I couldn't help notice the local politicians in trouble written up on the same page as this incident.
