If you follow the links from InstaPundit, one of the comments discounts this as a possibility. It says that Berger is accused of taking drafts of the after-action report that relates to the Millennium bombing attempt at LAX, while this footnote refers to the after-action report relating to the 1998 attempted bombing.

It's now known how many different documents Berger stole which he destroyed - recally there are reportedly 40-50 documents in question here and those do not include the ones which were stolen and never returned or taken before the Archives officials began monitoring him. In this case there are documents which are missing & the 9/11 commission could not locate them for viewing ... so somebody took them, albeit Berger recently or somebody else before him.
