You are missing my point entirely. I'm not denying that Berger is "toast". I fully understand the rules. What I am asking changes nothing about what Berger did, it just changes the implications and effects of his acts. There are two scenarios here, the first has no effect on the upcoming election or on Clinton's "legacy", the other has MAJOR implications on both.

Neither scenario changes the laws that Berger broke, he'll pay the price either way.

Actually, that doesn't sound like a generic description to me, more like a code word. Of course, this is CNN we're talking about. It's more likely that the reporter had the inspector's tag from his jockeys get stuck to his notes and tried to work it into the report.
