Kennedy Wants Fed Apellate Judge Off Bench

WASHINGTON (AP) - Sen. Edward Kennedy is trying for the third time to persuade the colleagues of federal appellate Judge William Pryor to bump him from the bench.

The Massachusetts Democrat is asking the 11th U.S. Circuit Court of Appeals in Atlanta to rule that President Bush's appointment of Pryor in February during a congressional recess was unconstitutional.

"Immediate consideration of this issue is critical: Judge Pryor has already sat or is scheduled to sit on over 60 cases, all of which may have to be reheard and re-decided if his appointment is ultimately adjudged invalid," Kennedy said in a brief filed in a case about police immunity from lawsuits.

He plans to mount a similar argument in another case that has been appealed to the U.S. Supreme Court, Kennedy aide James Flug said.

On the last day of Congress' weeklong Presidents Day break, Bush gave Pryor, a former Alabama attorney general, a seat on the court until January 2006. The Constitution gives the president authority to install nominees in office when Congress is not in session.

Democrats had blocked Pryor's confirmation by the Senate.

Recess appointments can only come at the end of a Congress or the recess between the annual sessions of Congress, not during a brief holiday, Kennedy wrote.

The president has defended Pryor's appointment as proper and necessary to overcome Democrats' "unprecedented obstructionist tactics."

Kennedy first raised the issue informally in a letter in March, suggesting that the court determine the validity of the appointment so as not to taint any decisions involving Pryor.

recess - A temporary interruption of the Senate's (or a committee's) business. Generally, the Senate recesses (rather than adjourns) at the end of each calendar day.

The Senate has never been squeamish about violating its own rules, to say nothing of their oath to fulfill its constitutional obligations. Best example I can think of is the Clinton "impeachment" trial, which actually never took place. Before that circus even started, Lott and Stevens made it clear to Schippers that there would be no conviction, no removal from office, no matter what the evidence against the presibent.

And such an ardent nazi sympathizer, that he went public with it, knowing this would have to enrage FDR and probably lose him his ambassadorial post -- which it did. So enthralled to Hitler was Joe P., that he was willing to scrap his political ambitions forever, just so he could wear his national socialist kneepads in public.

...and, made a deal with mobster Sam Giancano(sp) to steal the Illinois vote and give JFK the presidency. I think Sam had something to do with JFK's assassination after rhe Cuba fiasco and Bobby's turning on the mob.

Ted Kennedy is the sole reason our country has been over run by millions of illegals. Traitor, murderer, liar, rapist, general all around PIG. And, I might add, beloved Senator from that slime ball state that keeps him in power.

We need Cheney to tell Ted what he can do to himself, along with all the other Democrats in his state.
