I have to disagree with you here; returning the shot-up memo in and of itself is a reasonably actionable threat.
Go ahead and shoot up the memo (in a safe environment - backstop and all) and I would agree that it's No Big Deal. But to return it, holey, to the office is a clearly violent threat.
