Just a breaking news bar - the court has thrown out Newdows case on a technicality. Score one for the pledge.

In a perfect world the court would have ordered him, and his attorney to split 50/50 the state's attorney fees and costs in this case.

Oh all right. You guys are correct. But I find it disappointing anyway. There are plenty of times they should throw things out on technicalities yet choose not to because they can't resist comment. I have no respect for most of them anymore.

I find it a little weird that are talking about this as if the police in the 9th Circuit area were empowered to run around breaking into houses arresting people who included "Under God" in the pledge in their houses; people can say "Under Elvis," "Under Satan," or whatever they want in the pledge in their houses, on the street, etc. The issue, of course, is what students led by teachers in public schools were to be instructed to say.

The scary thing is that they dismissed the case rather than ruling on its merits. That meant that there was likely a four-four split (Scallia having recused himself for a dreadfully foolish comment he made on the case before getting it in the Court). If the Court had deadlocked, everyone covered by the 9th Circuit would still be banned from saying the pledge in school. WE dodged the bullet here but our liberty won't be safe until we take the gun away from the Court.

Note: The Newsdows case was thrown out on Flag Day. Who says the USSC isn't subtle.

Nevermind the 'under God' that was added later, the pledge itself was written by a socialist to advance a socialist agenda.

I personally pledge allegiance to the principles this country was founded on, as exemplified in a plain reading of the U.S. Constitution rather than to such abstractions as 'the Republic" and symbols like 'the Flag'

Make no mistake, I honor the flag, but I honor it because it represents the principles. I honor the principles through the flag. The pledge was written to seem to be patriotic while glazing over the essential principles. Classic leftist undermining.

Exactly. It is probably true that they should have thrown this one out on technicalities, but it is frustrating that the issue just remains for another day. I think they did this not becuase it was the right thing to do (he did not even have custody of his daughter), but because they were gutless.

Ordinarily I would agree with you. But I think it's better that THIS court passed. A future court might have more common sense.

Since the Court shot this one down on a procedural issue of standing, every other hoop will have to be jumped through by any subsequent litigant. Probably it will be kicked for some other reason next time. Lather, rinse, repeat, ad infinitum. The Court might never rule on this issue.

It will probably be a while before some disgrungled parent gets this particular bee in his bonnet again. To quote my favorite line from the movie Ruthless People, "Stupid people are a dime a dozen, but true idiots are rare..."
