| SCO posts loss vs profit; revenue down 52 pct Thu Jun 10, 2004 01:29 PM ET SEATTLE, June 10 (Reuters) - SCO Group Inc. (SCOX.O: Quote, Profile, Research) , the software developer suing to collect money from users of the Linux operating system, on Thursday reported a quarterly loss versus a profit as revenue fell 52 percent. Lindon, Utah-based SCO, which claims that parts of the Unix software code it owns are used in the free Linux operating system, posted a net loss of $15 million, or $1.06 per share, in its fiscal second quarter versus net income of $4,5 million, or 33 cents per share, a year earlier. Revenue fell to $10.1 million in the three months ended April 30 from $21.4 million a year earlier. SCO sued International Business Machine Corp. (IBM.N: Quote, Profile, Research) last year, accusing the world's largest computer company of violating its rights by putting parts of Unix into Linux, which can be copied and modified free of charge. SCO is also arguing that corporate users who have adopted Linux to cut information technology costs should now pay to use the system. SCO's main costs are associated with its legal bills, as well as charges it incurred to buy out one of its main investors, BayStar Capital. |

I believe it was demonstrated to the satisfaction of the court that Microsoft had inserted specific code into Windows, the only purpose of which was to scare people who were using DR-DOS.
In the IBM case, SCO was literally ordered by the court to produce these "millions of lines of code" that SCO has publicly stated were inserted into linux by IBM. In the end, their own lawyer admitted that there aren't any. They made the whole claim up, with no evidence whatsoever. This is in the court transcripts. It is one reason why IBM has now moved for summary judgement.
You tell 'em, FUDster. In case you haven't been paying attention, SCO's stock is now under five bucks and both of their big-time venture capital investors have taken a huge loss just to get away from the deal. Customers are staying away in droves. You're one of the last guys on Earth still peddling their BS.
Because I want the GPL revoked, and this is a good chance to do it. I have to admit, it will be almost impossible to beat IBM at trial, I mean the US Federal Government couldn't do it for ten years and they had an endless supply of funds. SCO is a small company that appears to have been swindled by Novell, and their funds obviously won't last forever in fighting both in court over it since their business has been destroyed. SCO may never win, but it doesn't mean that it wasn't a cheap shot by IBM and Novell to roll them over like they did.

What you call SCO bought nothing from Novell. They bought this business from the Santa Cruz Operation. Novell wasn't even part of the transaction. Your claim that Novell "swindled" them is just a lie that you like to repeat over and over again, now matter how many times it gets debunked. That's why people figure you for a professional liar from the Microsoft Corporation, or perhaps one of its PR agencies. If you were an ordinary human, you would put aside your lies as they get debunked. Instead you come back with them later, over and over again, which suggests a certain professional dedication in spreading them.
What a coincidence! So does Microsoft! All the other big hardware and software vendors are dealing with it just fine. It seems to be a crusade unique to the Microsoft Corporation -- and its shills, including SCO -- to prevent software authors from licensing their software in such a way that Microsoft can't legally use it in their products. Well, let Microsoft write their own software; they have $50 billion, they can write any software they want.
And they got whatever rights Novell sold originally, according to press reports and everyone's understanding - the rights to Unix. Novell's an Indian Giver, even if it turns out it was legal, which is just begining to be decided in court.
The whole thing is just so supicious and smelly. IBM gets sued for stealing code, and the number one defense put forth seems to be "Nah, Novell swindled you first."

I have nothing to do with the Microsoft corporation, although it's becoming quite evident that former if not current IBM employees are leading your side of the discussion, particularly in this thread. You want to be taken seriously with that accusation, go clean your own house which so obviously needs it first. Then, you can take my bet up to my full worth that I don't work for Microsoft. Till then, stuff it.
Your interpretation of press reports is not binding on the parties to a contract. The parties knew what was in it, and that's all that mattered. The Santa Cruz people didn't seem to think they'd been swindled at all. They ran that business for several years, until they sold it to Caldera Systems. Now Caldera (the "new SCO") says it isn't what they thought they bought. Well, whose fault is that? It can't be Novell's, they weren't even in on the deal. If Caldera got swindled, it was by the Santa Cruz Operation. Of course that company doesn't have any money, so they don't make a very good lawsuit target.
You'll have to fill me in on how that works. Do I get secret messages? Do I need a decoder ring? Whatever it is, I'm not getting the memos now. I think I know why, too. I think it's because they still remember me at IBM. See, when I was an undergrad, I interviewed with IBM. I got as far as a third interview with some big shot on the top floor of the building. So I put on my one and only suit, and I go in there and I talk to this guy for about an hour. I get out of there, and I have got to 'go' really bad. So I go into the bathroom, walk up to the urinal, and discover that my fly is already open. I went through the whole damned interview with my zipper open. Well, this was the old IBM with white shirts and stuff, and they didn't want any guys who walked around with their flies open. So that was the end of my career with IBM... alas, it ended before it began. And now they won't send me the secret memos about how to smite the Microsoft shills. I have to do it all by myself.
