He released him from custody pending the results of a sitting grand jury. The guy could still be indicted. Or did I read the news reports incorrectly?

The FBI said they had a 100 per cent match on the fingerprints then the Spanish authorities said the prints belonged to someone else so the judge (who hates Ashcroft with a passion BTW) threw out the case. Since we don't know if the prints are good or not, I guess we will have to wait.
