Lawyer: Top U.S. Officer Knew of Prison Abuse
Washington Post ^ | 05/22/04 | Scott Higham, Joe Stephens and Josh White

Posted on 05/22/2004 3:57:57 PM PDT by Pokey78

A military lawyer for a soldier charged in the Abu Ghraib abuse case testified that a captain at the Baghdad prison said the highest-ranking U.S. military officer in Iraq was present during some "interrogations and/or allegations of the prisoner abuse," according to a recording of a military hearing obtained by The Washington Post.

The lawyer said he was told that Lt. Gen. Ricardo S. Sanchez and other senior military officers were aware of what was taking place on Tier 1A of Abu Ghraib. The lawyer, Capt. Robert Shuck, also said a sergeant at the prison was prepared to testify that intelligence officers told him the abuse of detainees on the cellblock was "the right thing to do."

Shuck is assigned to defend Staff Sgt. Ivan L. "Chip" Frederick II of the 372nd Military Police Company. During an April 2 hearing that was open to the public, Shuck said the company commander, Capt. Donald J. Reese, was prepared to testify in exchange for immunity. The military prosecutor questioned Shuck about what Reese would say under oath.

"Are you saying that Captain Reese is going to testify that General Sanchez was there and saw this going on?" asked Capt. John McCabe, the military prosecutor.

"That's what he told me," Shuck said. "I am an officer of the court, sir, and I would not lie. I have got two children at home. I'm not going to risk my career."

We don't know what is true until we get the full story.

I had a feeling that someone was going to try and make General Sanchez a culprit. I worked with him when he was a Major, and may anyone who sullies his name and reputation go directly to hell.

Is this a career lawyer or just a Jag scholarship person who is just marking time till they can get into private practice. Remember who dominates law schools.

Sanchez could not get away with
such a thing, if true. He knows
that. Yet he's still in charge.

Or do you think it possible he
is that stupid?

I don't.

If he is, surely his stupidity is
hurting the war in many ways. Will
remain unconvinced, strongly, for
now.

General Sanchez is brilliant and a gentleman. He is not stupid.

I wonder if this (if true) puts Janis Karpinski's ass in the wringer ?

If Lt. Gen. Sanchez was there, wouldn't Karpinski also be there ?

I've watched too many criminal trials to start convicting Sanchez. Reese may have told the defense lawyer that without the eyewitness ability to back his statement..or if he wants immunity he's worried about his own hide.

I'll wait for the MI investigation..It ,too, will be leaked I would imagine..

I think she said they kept her out. I don't think they could keep Sanchez out if he wanted to be there.

I'm sorry if I misunderstood you. He is just one of the nicest, respected men I have ever met; and he still managed to run a tight shop, a rare combination in the military and elsewhere. A lot of times one can’t be both.

No. Who dominates the law schools?? To preempt what I suspect will be your pejorative response that law schools are led and populated by a cabal of sinister people with whom you have a reflexive disagreement, that is just plain foolish and emphatically wrong.

I see no link between what Sanchez
did or didn't and what Karpinski
did or didn't. And for what it's
worth, the Taguba report did not
support Karpinski's whiney-baby
claim.

I apologize for coming on so strong, but there is nothing phony about General Sanchez. What you see is what he is. He was working to augment his family’s income since he was little kid in elementary school and just kept on going. He is a real person with lots of morals and smarts.
