Vanity: Gun Transportation Advice

Posted on 05/09/2004 5:48:23 PM PDT by Mean Daddy

Have a permit to own a handgun in Iowa (do not have a concealed permit). Will be traveling by car to Missouri in the next couple of weeks and am wondering if I can bring my handgun with me legally.

While the advice of fellow FReepers is always well intentioned, you should contact the state patrol authorities for each respective state to get the answer.

Check out the NRA website... they may have the state info listed. It varies State to State.

Follow federal guide lines..... Empty, locked in a case, ammunition separate.

www.packing.org, will give you additional information.

3. Subdivisions (1), (5), (8), and (10) of subsection 1 of this section do not apply when the actor is transporting such weapons in a nonfunctioning state or in an unloaded state when ammunition is not readily accessible or when such weapons are not readily accessible. Subdivision (1) of subsection 1 of this section does not apply to any person twenty-one years of age or older transporting a concealable firearm in the passenger compartment of a motor vehicle, so long as such concealable firearm is otherwise lawfully possessed, nor when the actor is also in possession of an exposed firearm or projectile weapon for the lawful pursuit of game, or is in his or her dwelling unit or upon premises over which the actor has possession, authority or control, or is traveling in a continuous journey peaceably through this state. Subdivision (10) of subsection 1 of this section does not apply if the firearm is otherwise lawfully possessed by a person while traversing school premises for the purposes of transporting a student to or from school, or possessed by an adult for the purposes of facilitation of a school-sanctioned firearm-related event.

I am traveling across six states from Chicago(gun control king)Post 2 or 3 is very good check with the state police.

However, you can legally transport a firearm, unloaded, in a case and safer in the trunk with nil risk. I think this is stupid, however, this will work, unless you are a felon.

Sorry Mean,

I'm in MO and it's still pretty uncertain.

The legislature passed a CCW law that included ANYONE over the age of 21 to possess a handgun in a car (ie., on a car seat).

BTW, I'm not a lawyer, but I do golf.

"I think this is stupid"

Which part do you think is stupid? Transporting the firearm, or keeping it unloaded and locked in the trunk?

Don't ask don't tell.

I agree. Even if it is allowed...it is only a "defense of prosecution". You can beat the "rap", but you won't beat the "ride".

I've traveled many times through Missouri and I have always carried. Especially if I am with my family.

I have an legal answer to all handgun or all assault weapons cases in front of any court of law. Have the lawyer load a AK-47 or 9mm (or whatever gun you wish), place it on the judges bench in a vice away from all in attendance, have the lawyer back up 3 steps and DEMAND the gun to fire and kill him. This proves beyond the shadow of a doubt that guns don't kill people, people kill people.

If by some remote chance, and I mean a bazillion quadrillion octillian-to-one chance the gun fires itself and kills the lawyer then it would not be a great loss.

Ditto on the info at the website.

If JUST transporting is the goal, The rule of thumb is to keep unloaded in a locked container and the pistol in a snap case. The operative word is access and functional. No mention is made of what is being transported. The more secure you make it the better for avoiding trouble.

If stopped at a speed trap be very polite, take the ticket, and volunteer no information.

I don't know if Missouri offers out-of-state CCW permits. If not, check into getting a Florida non-resident CCW permit.

By so doing, you'll be "legal" in nearly 30 states, including Missouri (not Iowa though).

Yep. You need to have a permit issued by the County Sheriff before you can purchase a handgun.
