Canada prepares to enforce Islamic law

Canadian judges soon will be enforcing Islamic law, or Sharia, in disputes between Muslims, possibly paving the way to one day administering criminal sentences, such as stoning women caught in adultery.
Muslims are required to submit to Sharia in Muslim societies but are excused in nations where they live as a minority under a non-Muslim government.

Canada, however, is preparing for its 1 million-strong Muslim minority to be under the authority of a Sharia system enforced by the Canadian court system, according to the Canadian Law Times.
Muslim delegates at a conference in Etobicoke, Ont., in October elected a 30-member council to establish the Islamic Institute of Civil Justice.
The institute is classified in Islamic law as a Darul-Qada, or judicial tribunal. Its bylaws are scheduled to be drafted and approved by Dec. 31.
Cases will be decided by a Muslim arbitrator, but the local secular Canadian court will be the enforcer.
One of the obstacles to establishing the system, the Law Times said, has been the Muslim communities' lack of unity and organizational strength. Muslims in Canada come from many different countries and different schools of Islam. Also, there are few Islamic legal scholars, known as ulama, in North America, which are essential to adjudicating complex issues.
"It seems as if the community was looking forward to something like this," says organizer B. Husain Bhayat, according to the Law Times. "If all groups are represented, with hard work and the unity we saw here, we will have no difficulty going forward."
The two main streams of Islam, Sunni and Shi'ite, were represented at the conference, along with imams and leaders of organizations.

"... What's wrong with letting people decide they want their personal disputes governed by Talmudic law instead of English Common Law?" That would almost make sense if Islamic civil cases in some Muslim countries didn't end up with people being blinded in one eye, hands being cut off, or having female family members sold into whoredom to pay outstanding debts.
Oughtta be a load of laughs when someone is ordered to sell their daughter -- a Canadian citizen, mind you -- into an arranged marriage with a Pakistani living abroad.
Would Canada protect that girl, or would they help spirit her away to a foreign land like Janet Reno did to Elian?

If that door gets opened a crack...just a crack...Letting people resolve their disputes without resorting to the regular court system is a good thing. And the door is open in nearly every country I know of, since arbiters are cheaper and work faster than a court; many have specific areas of expertise, unlike the average local judge. Moreover, if your basic legal rights are violated in such a process, you can sue in a regular court -- for example, if the other party doesn't abide by the arbiter's ruling.
The problem with the proposed scheme here is that the public will probably be paying for it, rather than the parties to the dispute.

The Brits don't seem to do much for them, although that is accomplished by looking the other way, not via any enforcement proceedings. I recently heard this was going to change, but I don't know if it has.

In Saudi Arabia, the Sharia court is the
only choice. In the US (and Canada), submitting yourself is up to you.
To answer your question, if you read the actual Ontraio Arbitration Act, you'll see that arbitration verticts can only be enfored by the regular court. In other words, the only way someone can be forced to sell their daughter through this process is if the regular court would allow that. If it does it's a problem with the regular court, and entirely independent of whether arbitration by Imam is ok.
By the way, if you feel like having your disputes governed by your local Parish Elders, read the Federal Arbitration Act as well as your applicable state law.

There is the difference between America and Canada, If I try that in America, I will probably never get citizenship. I think you missed the fact that choosing arbitration is a
voluntary act. How does letting other people choose to be governed by Islamic law when in pertains to disputes
between then makes me "live under these laws"? I don't want to be subject to Islamic law, but I don't see why I should prevent others to submit themselves to it, as long as they have the choice not to.
Say you and I sign a contract where we both agree that a local alderman will serve as arbiter in case of a dispute. Do you think that make every US citizen suddenly have to follow rulings issued by that person?
