I think they want to wage a PR war, then quietly lose in court. If they didn't think they owed the check, they would not have written the check. Sounds like they gave him a check that had no funds behind it, and asked him to hold it for a short while before cashing it. Perhaps they thought that an avalanche of advertisers, throwing money at them would make the check good.
