Weve fought a number of battles together to make California and this nation a better place.
I am writing to you today about a politician who seems to have forgotten that he works for us and no, I am not talking about Gray Davis this time. Just like we forced Davis ally, Secretary of State Kevin Shelley, to call the special recall election when he was trying to weasel out of it, we now have to compel another state official to do his job.
This time we need to put pressure on State Controller, Steve Westly, to do his job and account for hundreds of millions of dollars.
The National Tax Limitation Committee (NTLC) has alerted me to an investigation they conducted which determined that State Controller Steve Westly (D) has failed to account for hundreds of millions of dollars that were to be turned over to California auto insurance ratepayers in accordance with Proposition 103, which required rebates to policyholders.
To comply with Proposition 103, more than 100 automobile insurance companies engaged in settlements with the State of California totaling $1.4 billion. The settlement money was to be returned to California insurance policyholders owed a rebate as required by the vote on Proposition 103. With respect to policyholders who could not be located by the insurance companies, their rebates would flow (escheat is the legal word for it) to the State Unclaimed Property Fund for the benefit of California taxpayers.
To facilitate the requirements of Proposition 103, the California Legislature enacted California Civil Code of Procedure Section 1523, which declared that: If an insurer, after a good faith effort to locate and deliver to a policyholder a Proposition 103 rebate determined that a policyholder cannot be located, all funds attributable to that rebate escheat to the state and shall be delivered to the Controller.
It has been the responsibility and obligation of the State Controllers office to ensure that any rebates not delivered to policyholders escheat to the State of California. However, it appears that the Controller has not collected the unclaimed rebates as they are not listed as property within the custody of the State Controller, said National Tax Limitation Committee President Lew Uhler.
Lew Uhler and the NTLC have asked that we help put pressure on the State Controller to do his job. They need our help, and I need you to take action right now!
Please, take a brief moment and write to the State Controllers office and demand that they collect and account for the hundreds of millions of dollars of missing Proposition 103 rebates. Please send emails to all four of the following addresses:

At a time when the state is facing cuts to health care, education and law enforcement, it is inexcusable to have the State Controller fail to come up with such a large chunk of money - of which funds could be used to spare so much of the cuts we face!
Or, if the liberal majorities in the Legislature have their way, we will all be facing tax increases to pay for the excessive spending during the Davis Administration.
Thank you for continuing to work hard to make California a better place to live! Lets make sure that State Controller Steve Westly has learned the same lesson that Gray Davis and Kevin Shelley learned: listen to the people or they will strike back!

Arnold's already talking about tax increases - we can't allow hundreds of millions to disappear and then hear about how we have to have our taxes raised!!
MORE BUMPS to the rest of you!!! Let's flood Westly with complaints until he realizes he cannot hide his fiscal indiscretions with the taxpayers' money!!
