Although I have seen info that he was release from his reserve obligation in 1978, I think he actually was not in the reserves at this time. I don't know how, but I think I read that such was the case.

I've not seen anything definitive on this. If Kerry, somehow, had not been formally listed as being in the Reserve, he still had the obligation of every citizen to report what was a manifestly seditious proposal - and definite possibility. To not report it, implies complicity. That would be the take in any court of law.
