I think Lehman said two things:
#1. That Clarke had helped the Commission so much in providing a blueprint regarding the questions they should ask. He did this privately.
#2. That Clark had also TESTIFIED privately for 15-16 hours and his testimony private was a 180 from his public testimony.
I'm virtually positive that private testimony is under oath. Rice, Cheney, etc. all testified or will testify privately and it is under oath.
