I was told smoked moose was tastier than poached moose but I could never get the dang thing lit.

I could never get the dang thing lit.Tommy Chong sold a bong big enough to smoke a moose but the feds seized it when they raided his company.

Technically, he is not a poacher, but a violator.
I live in a very rural area where there are many 'violators', or people who hunt out of season, take more than their license permits, fail to get a license, hunt at night with a light, hunt with a rifle during bow season, etc. These are violators.
A poacher is technically someone who hunts on anothers private property without permission.

In these kind of cases, I generally recommend that the accused present a case of mistaken identity, claiming that that instead of a moose, he thought it was an unborn child.
In most cases this will result in immediate dismissal of the charges, and not infrequently in a parade through town, adulatory appearance on The Today Show and other fringe benefits.

Violators should be fined (and as you said Elvis this guy seems like a poacher). Hunting is great but rules need to be followed.
Poachers on the other hand should be shot. Some guys trudging through your ranch with rifles shooting at anything that moves basically deserve what they get. Especially if you have family in the ranch.

In most cases this will result in immediate dismissal of the chargesThis would work in NY, NJ, MA, CT, RI, CA, DE and MD EXCEPT the perpetrator used a (horrors) gun. Then they let him go on the poaching charge, but charge him with the most evil thing a person can do (in those jurisdictions anyway) a gun crime.

Yes...
I refered to a violator as a poacher. Those are fightin' words. He was truly offended. This is when I learned the difference.

Hmm, good point, the use of a gun is a problem. Guess he'll have to go for the full psychotic-episode defense and claim he thought the gun was a vacuum nozzle.
